Terms of Use and Ordering Conditions

These terms govern your access to and use of the namtech.vn website and any order request you submit through the website's cart. The website is operated by CÔNG TY TNHH CÔNG NGHỆ N.A.M (international name: N.A.M TECHNOLOGY COMPANY LIMITED; short name: NAMTECH):

("Namtech", "we", "us"). Please read them carefully before using the website or submitting an order request.

1. Acceptance of terms

By accessing or using the website, or submitting an order request, you confirm that you have read, understood and agree to these terms and our Privacy Policy. If you do not agree, please stop using the website.

2. About the website and services

The website presents:

Articles, technical specifications and reference information on the website may be updated or changed without prior notice.

3. Roles of the parties when buying machines and accessories

4. Ordering through the cart

4.1. An order submitted through the cart is an order request. It is not a payment and does not form a sales contract. The website does not take online payments.

4.2. After you submit a request, the system shows a reference number (format MS-YYYYMMDD-XXXX). Namtech or the Seller will call you to confirm the configuration, quantity, price, delivery time and invoice details. Namtech enters the confirmed order into the Seller's order management system so that the Seller can process the sale, invoicing and delivery.

4.3. A sales contract is formed only when the order is confirmed with you under section 4.2. Confirmation takes one or more of the following forms: an order confirmation email sent to you; a signed contract or purchase order; a value-added tax (VAT) invoice.

4.4. Before your order is confirmed, you may cancel your request free of charge by contacting Namtech at +84 918 476 556 (Mr Tân) · +84 902 771 986 (Mr Nam) or nam@namtech.vn.

4.5. Namtech and the Seller may decline or not confirm an order request (for example: out of stock, contact details cannot be verified, an obvious pricing error) and will notify you.

4.6. You undertake that the information you provide when ordering (full name, phone number, email, delivery address, company invoice details) is accurate. When you enter a tax code, the website may auto-fill the company name and address from the VietQR lookup service; you are responsible for checking and correcting it.

4.7. Information you submit through the cart is delivered to Namtech via the Brevo email service; for lookups, only the tax code is sent to VietQR. Personal data is processed under our Privacy Policy and Vietnam's Personal Data Protection Law No. 91/2025/QH15.

5. Prices, promotions and availability

5.1. Prices of Mac computers, accessories and the Mac-for-AI rental service fees displayed on the website are in Vietnamese dong and include value-added tax (VAT). Software prices and operating fees for the internal AI platform packages shown on the home page are indicative and exclude VAT.

5.2. Prices may change due to manufacturer pricing, exchange rates or stock availability. Prices are recalculated by our system when you submit an order; if the price shown in your browser differs from the system price, the system price applies. The final price is the price confirmed with you on the confirmation call. If the confirmed price differs from the price you saw when ordering, you may choose not to proceed.

5.3. Promotions (multi-machine discounts, discounts on accessories bought with a machine, discount codes) apply according to the conditions displayed on the website at the time you submit your order. Discount codes are re-checked by our system; invalid or expired codes will not be applied.

5.4. "Expected availability" in the cart is calculated as the date published by Apple Store Vietnam plus 5 working days (excluding Saturdays and Sundays). "Expected ready" on the Mac-for-AI rental page is calculated as the latest date published by Apple Store Vietnam plus 5 working days. This information is for reference only and is not a commitment by Namtech or the Seller. The actual delivery time is confirmed on the confirmation call.

6. Payment

6.1. You pay for machines and accessories by bank transfer to Decorp's account before delivery. The account details for payment are provided when your order is confirmed.

6.2. Namtech's service fees (if any) are paid under a separate quote or service contract between you and Namtech.

7. Delivery

7.1. Delivery area: nationwide in Vietnam.

7.2. Delivery fees: free in Ho Chi Minh City and Hanoi. Delivery fees to other provinces and cities (if any) are advised when your order is confirmed.

7.3. Delivery time: based on stock availability; Namtech confirms the specific delivery time on the confirmation call.

7.4. Passing of risk: risk in the goods passes to you when you (or your authorised representative) sign for the delivery, unless the parties agree otherwise.

7.5. If you leave the delivery address blank when ordering, Namtech will ask for it when confirming the order.

8. Invoices

9. Returns and warranty

9.1. Machine warranty: Mac computers carry Apple's 12-month genuine warranty, serviced at Apple-authorised service centres under Apple's warranty terms.

9.2. Exchanges: you may exchange the machine for a new one within 7 days of receipt if it has a manufacturer's hardware defect and is still in its original box.

9.3. Namtech service warranty: the AI software installation and tuning services performed by Namtech carry a 60-day warranty from handover.

9.4. Nothing in these terms limits consumers' rights under Vietnamese consumer protection law.

10. AI computing capacity service (Mac-for-AI rental)

10.1. Provider: the "Mac-for-AI rental" service (page /thue-mac-studio-en) is provided directly by CÔNG TY TNHH CÔNG NGHỆ N.A.M (Namtech), tax code 0313959901, registered office at Phòng 802, Vietnam Business Center, 57–59 Hồ Tùng Mậu, Phường Sài Gòn, TP Hồ Chí Minh, Vietnam.

10.2. Nature: this is a service contract (Article 513 of the 2015 Civil Code) for AI computing capacity on Mac computers together with management services; it is not a lease of property. The machines are owned by Namtech, located at Namtech and are not delivered to the customer.

10.3. Scope of use: the customer uses the service only to run AI models via an API (the API may be accessed over a VPN connection). Namtech does not grant remote control of the machines.

10.4. Term: 12 months.

10.5. Prices and payment: service fees listed on the website include 10% VAT. Service fees are paid in advance for each period, together with a security deposit, by bank transfer. VAT invoices are issued by Namtech.

10.6. Suspension: if payment is overdue, Namtech may suspend the service (lock access) while retaining the customer's data during the suspension.

10.7. End of contract: when the contract ends, Namtech deletes the customer's data on the machine and makes a written record confirming the deletion.

10.8. Personal data contained in the data the customer puts on the machine is processed as described in the relevant section of our Privacy Policy. Detailed terms of the service (configuration, fees, security deposit, data processing) are set out in a separately signed service contract between the customer and Namtech.

11. AI services and third-party software

11.1. Software such as MLX, Ollama, LM Studio and AI models are third-party products used under their authors'/publishers' licences. Namtech does not own this software or these models.

11.2. Output generated by AI models may be inaccurate or incomplete. You are responsible for checking output before relying on it. In line with Vietnam's Law on Artificial Intelligence No. 134/2025/QH15, an AI system does not replace the authority and responsibility of the human decision-maker.

11.3. Performance figures on the website (speed, model sizes that can run) are indicative and depend on the machine configuration, software version and specific model.

You agree not to misuse the website. In particular, you must not:

13. Intellectual property

Content, articles, images, logos and the NAMTECH brand on the website belong to Namtech or its licensors. You may not copy, distribute or reuse them without Namtech's prior written permission. Apple, Mac, Mac Studio and Mac mini are trademarks of their respective owner; they are named on the website only to describe the products.

14. Third-party links and content

The website may contain links to external sites. Namtech does not control and is not responsible for their content, policies or practices.

15. Disclaimer regarding website content

Informational content on the website (articles, comparisons, indicative specifications) is provided "as is". This does not apply to obligations in respect of goods and services confirmed under section 4 — those are performed according to the confirmed order, the warranty policy and Vietnamese law. Scope and pricing of custom software/AI projects for businesses are settled by a separate quote or contract.

16. Limitation of liability

To the extent permitted by Vietnamese law, Namtech is not liable for indirect damages arising from your use of, or inability to use, the website. This limitation does not exclude any liability that cannot be excluded by law, including consumers' rights.

17. Governing law and dispute resolution

17.1. These terms and transactions arising through the website are governed by the laws of Vietnam.

17.2. The parties will first try to resolve any dispute through negotiation or mediation. If it cannot be resolved within 30 days from the date one party notifies the dispute, it will be resolved by the competent People's Court of Vietnam.

18. Changes to these terms

We may update these terms. The new version will be posted on this page with its update date. A confirmed order is governed by the terms in effect at the time of confirmation.

19. Language

These terms are made in Vietnamese and English. In case of any inconsistency between the two versions, the Vietnamese version prevails.
